The Clinch County Probate Court exercises exclusive, original jursidiction in the probate of wills, administration of estates, appointment of guardians and involuntary hospitalization of incapacitated adults and other individuals.
Also, the Clinch County Probate Office provides birth certificates. You may obtain a birth certificate by calling, writing, or visiting the Probate Judge's office.
Jurisdiction for Magistrate Courts includes small claims (under $15,000), minor and felony criminal offenses, dispossessory writs, warrants, good behavior warrants, bad check warrants, preliminary hearings, arrest and search warrants.
Magistrate grants bail in cases that are not reserved exclusively to a judge of another court. Jury trials are not held in Magistrate Court. If a defendant submits a written request for a jury trial, case may be transferred to Superior Court.
